Need Small Claims / Contract Advice?

Arbitration? For small claims??? WTF. What are we talking about, a few hundred dollars? Guy has been in the business for 25 years -- why doesn't he just say, "Here's your money back. I want to maintain my good reputation, and ensure that all my customers are satisfied, happy customers." Sheesh.
